Terms of Use

These Terms are a legal agreement between you and FaceStudio ("FaceStudio", "we", "us") governing your use of the FaceStudio iPhone app and related services. By downloading or using FaceStudio, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

1. Eligibility (18+)

FaceStudio is for adults only. You must be at least 18 years old and able to form a binding contract to use the app. By using FaceStudio you represent that you meet this requirement.

2. The service

FaceStudio lets you upload a video, automatically detect the faces in it, and replace one or more of them with a source face you choose, using GPU-accelerated AI. Outputs are AI-generated and may contain imperfections. Processing times and capabilities depend on your device, your video, and current demand.

3. Your account

You sign in with Sign in with Apple. You are responsible for activity that occurs under your account and for keeping your device secure. You may delete your account at any time from Settings → Delete Account.

4. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use FaceStudio on Apple devices you own or control, for your own non-commercial, lawful use. You may not copy, modify, distribute, sell, reverse-engineer, or attempt to extract the source code of the app, except where such restriction is prohibited by law.

5. Acceptable use

FaceStudio is for fun, consent-first creativity. You agree that you have all rights and permissions needed for every face, person, likeness, and video you upload or create, and that you will not use FaceStudio to create, upload, or share content that:

• Depicts a real person without their consent, or that you do not have the right to use;
• Sexualizes, sexually exploits, or depicts minors in any way (we have zero tolerance and report child sexual abuse material to the authorities);
• Is pornographic, sexually explicit, or non-consensual intimate imagery;
• Impersonates a real person to deceive, defraud, defame, or harm — including fake endorsements, fabricated statements, or misleading "deepfakes";
• Harasses, bullies, threatens, or incites violence or hatred against any person or group;
• Is intended to mislead in elections, politics, finance, or other consequential matters;
• Violates any law, third-party right (including privacy, publicity, and intellectual-property rights), or the rights of any individual;
• Attempts to disrupt, overload, probe, or abuse the service or circumvent its limits or safeguards.

6. Your content

You keep ownership of the content you upload and create. You grant us a limited license to host, process, and transmit your content solely to operate the service for you (for example, to run the swap and deliver your result). Your source uploads are deleted automatically after processing as described in our Privacy Policy. You are solely responsible for your content and for how you use any output, and you agree to indemnify us against claims arising from your content or your misuse of the app.

7. Subscriptions & billing

FaceStudio Pro is an auto-renewable subscription sold through your Apple ID and managed by Apple's App Store.

• A free trial may be offered to new subscribers. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
• Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renewal, in iPhone Settings → your Apple ID → Subscriptions.
• Prices are shown in the app and may change; we will give notice as required.
• Purchases, refunds, and billing are subject to the App Store Terms of Service. Refunds, if any, are handled by Apple under its policies.

8. Intellectual property

FaceStudio, including its software, design, branding, and content (excluding your content), is owned by us and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.

9. Disclaimers

FaceStudio is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. AI outputs are generated automatically and may be inaccurate or imperfect. We do not warrant that the service will be uninterrupted, secure, or error-free. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, FaceStudio and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the app. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim, or USD 50, whichever is greater.

11. Termination

You may stop using FaceStudio and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the service or other users. Sections that by their nature should survive termination (including content responsibility, disclaimers, limitation of liability, and governing law) will survive.

12. Apple terms

The following apply because FaceStudio is distributed through Apple's App Store:

• These Terms are between you and FaceStudio only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to furnish any maintenance or support for the app.
• To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app; any claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility, not Apple's.
• Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability, legal/regulatory, and intellectual-property claims.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

13. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws rules, except where the law of your country of residence requires otherwise. Nothing here limits any mandatory consumer-protection rights you may have where you live.
